YOUR EQUITY PRIVACY NOTICE

Your Equity Limited (YE / our) is a consultancy business. Our clients (you / your) are generally small to medium sized companies across a variety of sectors. Our aim is to help you enhance your business performance.  Our speciality is to assist you to: optimise your marketing strategy, improve media presence, expand your customer base and refine your customer journey.

Protecting your privacy and data security is very important to us. This notice explains how YE store and use the information you have provided in line with the obligations of the General Data Protection Regulations (GDPR) & the Data Protection Act. It also details your rights with regard to data we hold about you. Please read it all thoroughly.

YE place paramount importance on customer service and always endeavour to meet your expectations. For clarity `personal information` is that which can be used to identify you or an individual. The notice applies to data YE hold on you or is provided by you to YE.

Purpose For Processing Your Data

YE needs to process data for the following reasons: billing & invoicing, to access your websites & advertising platforms, to communicate with you and your suppliers, to personalise your media content, to carry out analysis of your business demographic base, to establish the terms between YE & you and for legal purposes (such as crime prevention). This list is not exhaustive.

Lawful Basis For Processing

YE`s lawful basis is:   “processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.“

 

The Legitimate Interests For Processing

YE are in the business of working with its clients to help them improve their content, media presence, communications and customer journey. To achieve this YE rely on the following legitimate interests:

– As you are a client of YE the processing represents a relevant and appropriate relationship so that we can meet the obligations of YE`s tasks, agreement or contract with you.

– Where the processing enables us to enhance, modify, personalise and generally improve our communications / services to you and your communications / services to your customers.

– To better understand how users interact with your media presence to help you to optimise the same.

– To identify and help to prevent crime.

– To determine the effectiveness of any promotional campaigns and advertising.

– To better understand your customer base in broad terms in order to assist your customer acquisition.

 

When processing personal data YE will always ensure that personal data rights are kept in high regard and take account of rights under General Data Protection Regulation and the Data Protection Act.

You can object to YE processing any data supplied by / held on you at any time using the contact methods at the beginning of this document. In this event YE will stop processing the data and delete it within a short time period (maximum of one month), except where it has to be kept for legal and / or compliance purposes.

Categories of Personal Data Obtained

Levels of data obtained are kept at a basic level to include only enough information to facilitate our business requirements.

Typically YE may hold the following information;

Title; Name; Job Title, Status, Address; Postcode, Telephone Number, Email,  Age,  Product Interest.

 

 

Recipients Of Personal Data

YE will treat personal data confidentially. Only when necessary YE may need to share some of this with; our insurers, our banks, our solicitors, our accountant, our contracted service suppliers (e.g. designers), providers already used by or approved by you and legal bodies (where we are required / compelled to do so). Should YE wish to share your data with anyone outside of this list we would first obtain your permission to do so.

If you wish to share personal data you have collected with YE you should only do so where you have permission to do so. You would be the controller of such data in such circumstances should they arise.

Storing Of Your Data

Soft / digital data is stored on a computer within an encrypted folder. Access to the computer is also password protected and it runs the latest antivirus, firewall and security software. Hard copy / paper data is kept in a folder inside a locked filing cabinet in a locked building.

Retention Periods For Personal Data.

Data which specifically may be required for legal / contractual requirements YE will keep data for up to 3 years after our relationship ends or as long as law / the contractual obligations dictate.

Otherwise data will be retained for no longer than reasonably necessary. Where data is only required for a short time the aim is to permanently delete / destroy this as soon as possible and in any case within 6 months.

Your Individual Rights, Contacting Us & Making A Complaint

The Right To Be Informed – You are informed of your rights through accessing our privacy notice via: a hand delivered copy / or a posted copy and / or an email or another suitable medium.

The Right Of Access – You can ask to see the data YE hold on you. After checking your identity using reasonable means, you will then be provided the information within one month, in a commonly used format. YE will not normally charge a fee for this service. YE may charge a ‘reasonable fee’ when a request is manifestly unfounded or excessive.

The Right To Rectification – If you believe or become aware that relevant data YE hold is inaccurate you can ask YE to correct it. YE will do this for you within one month. YE will not normally charge a fee for this service. YE may charge a ‘reasonable fee’ when a request is manifestly unfounded or excessive.

The Right To Erasure –Where you request YE to erase your data from our records YE will endeavour to do so within one month. Some data may have to be retained as part of any legal obligation to do so. If that is the case YE will explain what is to be retained, for how long and why.

The Right To Restrict Processing -You can ask YE to stop processing your data at any time. YE will stop processing without undue delay and within one month.

The Right To Data Portability – Although under legitimate interests this right does not generally apply YE will aim to provide you with a copy of the relevant data held in a common format within one month of you requesting it.

The Right To Object –  You can object to our processing your data for marketing and / or any  other purposes at any time.

The Right To Withdraw Consent – Where you have provided consent for YE carry out a specific process you can withdraw this at any time. You can also withdraw your consent to marketing (if applicable) at any time.

You also have the right to make a complaint to the Information Commissioners Office (ICO) (which is a supervisory authority) about how your data has been processed. You may also contact the ICO directly, for their up to date contact details please visit www.ico.org.uk.

Special Category Data

This data relates to sensitive areas such as: racial or ethnic origin, political opinions, religious beliefs, trade union membership, physical or mental health, biometric data, genetics and sexual life. YE does not collect or store special category data at the current time.  Should YE start to gather such data it will only be processed where it is needed to provide a service you have requested and then only with your consent. You have the right to withdraw your consent at any time with regard to processing any special category data.

YE do not expect to disclose any special category data unless we are compelled to do so for legal purposes.  If we are required to disclose or process such data this will only be with your explicit consent.

Marketing & Right To Object

You have the right to object to receiving marketing material at any time. In the first instance please contact YE and your objection will be dealt with without undue delay.

There may be times when YE feel that a service or product offered by YE or a selected third party may benefit you. Only where YE have your permission to make you aware of alternative services or products, YE may contact you to provide further details so that you can make an informed choice.

Actions Of Other Organisations

As part of our service YE, with your permission, may wish to pass your data on to another organisation in order to assist you with the right service. Any data YE pass to them plus any data requested or gathered by that business will be held by that business for the purposes they have set out in their own privacy notice. Please ensure you are happy with their use of your data before accepting any agreement or service.

Credit Referencing Of Our Business Customers

When an enquiry is received by YE from a business interested in our services, information may be sought from credit reference agencies on the company and/or partners and/or directors as individuals, but only with the appropriate permission from the parties concerned.

Research & Statistical Analysis

YE may occasionally use your details to assist in understanding our customer needs and business trends in order to improve the products and services on offer.

What personal data we may collect when you use our website and why we collect it

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
